(Q) Is there any special precautions that [
195] should
take, or any suggestions as to presenting evidence?
(A) The conditions as they are set at present are very
good. There may be some conditions, or evidence attempted
to be presented by [
4687] that the representative of [
195]
should be in position to meet same. That is, as reference
to some conditions or associations with others in the East,
New York, and promises as were made for these considerations
when the developments were made, for there were to be
others; that is, that were in the East, that were to supply
certain funds for certain conditions. Some were never
supplied. Some will be offered as were supplied in part.
(Q) Who are these associations?
(A) Gar [?] - Gial [?] - is all we get. Gayle or -
(Q) Gayle of New York?
(A) Of New York.
(Q) Would it be advisable to accept two-thirds offer of
compromise?
(A) Be advisable to accept two-thirds offer of compromise,
provided all other claims as would be or might be presented
against the association were taken care of by [
4687].
(Q) Would this offer include other deals other than Connell
matter?
(A) Include other deals.
(Q) In the Ruby suit, which [
195] won and which is to be
appealed, should [
195] make offer of compromise or fight
suit? If compromise, how much?
(A) The compromise as has been offered would be acceptable
to Ruby party, and if only held out and offered again,
letting them (Ruby's representatives) make the approach, we
will find it would be settled through this means and in
better manner than carrying through suit, for either.
(Q) How much was this compromise?
(A) One-third - and attorney fee.
(Q) Any other suggestions for [
195] connected with these
associations?
(A) No. Only follow these, as we have given here.
(Q) Will offer of compromise be made in cash?
(A) Settlements of and through some holdings, and cash -
yes. Utah. This is labor as is performed on properties
in Wyoming, Utah, Dakota.
(Q) How will the balance of settlement be secured?
(A) Cash and the offering.
(Q) How would [
195] be secured or guaranteed in the balance
that is not paid in cash?
(A) In holdings in other portions of the association that
would be put up. Be some that would be very valuable.
(Q) They will offer him these holdings?
(A) Offer him these holdings?
(Q) Are they worth anything?
(A) Some are very valuable. Especially those here where
the spring is.
(Q) Are they leases or patented lands?
(A) Patented lands and lease.
(Q) Where is this Spring?
